1. Service Description

InsightOS is a cloud-based marketing analytics and revenue intelligence platform designed for agencies and growth teams. The Service provides data aggregation, cross-channel performance dashboards, AI-powered insights, anomaly detection, and reporting capabilities.

By accessing or using InsightOS, you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Account Terms

You must provide accurate and complete registration information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify InsightOS immediately of any unauthorized use.

Each user account is intended for use by a single individual. Sharing login credentials between multiple people is not permitted. Organizations may create separate accounts for each authorized user under their workspace.

You must be at least 18 years of age to create an account and use the Service. InsightOS reserves the right to suspend or terminate accounts that violate these terms or are used for unlawful purposes.

3. Payment Terms

Certain features of InsightOS require a paid subscription. Fees are billed in advance on a monthly or annual basis depending on the plan selected. All fees are non-refundable except as expressly stated in these terms or required by applicable law.

InsightOS reserves the right to modify pricing with at least 30 days' written notice. Price changes will take effect at the start of your next billing cycle. If you do not agree to a price change, you may cancel your subscription before the change takes effect.

4. Data Usage

You retain all rights to the data you submit to InsightOS. By using the Service, you grant InsightOS a limited license to process, store, and display your data solely for the purpose of providing and improving the Service. We will not sell your data to third parties.

InsightOS may generate aggregated, anonymized statistics from usage data for the purpose of improving the platform. Such aggregated data will not identify you or your organization. For full details on how we handle your data, please refer to our Privacy Policy.

5. Intellectual Property

The InsightOS platform, including its software, design, logos, documentation, and all related intellectual property, is owned by InsightOS and protected by copyright, trademark, and other intellectual property laws. Nothing in these terms grants you ownership of the Service or its underlying technology.

You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the Service without prior written consent. Any feedback or suggestions you provide about the Service may be used by InsightOS without obligation to you.

6. Limitation of Liability

To the maximum extent permitted by law, InsightOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of your use of or inability to use the Service.

InsightOS's total aggregate liability for any claims arising from these terms or the Service shall not exceed the amount you paid to InsightOS in the twelve months preceding the claim. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

7. Termination

You may cancel your account at any time through your account settings. Upon cancellation, your access to paid features will continue until the end of your current billing period. InsightOS will retain your data for 30 days after termination, after which it will be permanently deleted.

InsightOS may suspend or terminate your account if you violate these terms, fail to pay applicable fees, or engage in conduct that is harmful to other users or the integrity of the platform. We will provide reasonable notice before termination unless immediate action is required for security reasons.

8. Changes to Terms

InsightOS reserves the right to update these Terms of Service at any time. We will notify you of material changes by email or through a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised terms.

If you do not agree to the updated terms, you must stop using the Service and close your account. It is your responsibility to review these terms periodically for changes.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association, except where prohibited by law.

Nothing in these terms shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
